PURPOSE OF REQUEST
The City of Airway Heights is seeking to appoint a part-time presiding judge for Airway Heights Municipal Court. The city operates under Council-Manager form of government, with the judicial appointment for the statutory period (See RCW 35A.13.080; RCW 3.50.040; RCW 3.50.093).
GENERAL INFORMATION
Airway Heights Municipal Court currently holds sessions on the 2nd & 4th Monday and Tuesday of the month with the 4th Thursday and Friday of the month reserved for trials.
Daily first appearances and therapeutic court each Wednesday. The position is periodically on call.
The City of Airway Heights Municipal Court has exclusive jurisdiction over parking, traffic and non-traffic infractions, and misdemeanors in violation of local ordinances that occur and are cited by law enforcement within the city limits of Airway Heights. See RCW Chapter 3.50 and Airway Heights Municipal Code Titles 9 and 10.
The City is growing at a rapid pace. Municipal Court filings are expected to increase over the next several years. The court currently receives filings from two primary law enforcement agencies: Airway Heights Police and Kalispell Tribal Police.
Organization of Courts
The Municipal Court is organized and constituted as the Municipal Court of Airway Heights, pursuant to Chapter 3.50 RCW. The Municipal Court has four full-time employees: (1) Court Administrator (2) Judicial Specialist, and (1) Therapeutic Court Coordinator.
Court office hours are 8:30-4:30 Monday through Friday.
Qualifications
Consistent with RCW 3.50.040 and RCW 3.50.057 all applicants must be citizens of the United States, resident of the State of Washington, and a resident of Spokane County. Applicants must be admitted to practice law before the courts of record of Washington.
- Minimum Education and Experience
- Minimum of five years as an attorney;
- Required to attend Washington State Judicial College within one year from appointment;
- Must maintain continuing education credits;
Compensation
Municipal Court services will be paid at a flat rate per month as set forth by written agreement. The fee is inclusive of all judicial and administrative duties, required under RCW Chapter 3.50 and GR29. The City provides additional funding for judicial conferences and travel expenses.
Term
The effective date of the Airway Heights Municipal Court presiding judge will commence upon appointment by the city manager and confirmation by city council with an expiration date in compliance with RCW 3.50.040. Upon appointment, the Judge will be required to take an oath as set forth under RCW 3.50.097.
